The arrest affidavit for the man who was arrested in connection to the disappearance and presumed death of Michelle Parker is still sealed, but on Friday prosecutors requested that the court modify the order.

Dale Smith, 55, has long been considered the prime suspect in Parker’s disappearance in November 2011. He was arrested Wednesday and a day later, remanded without bond to the Orange County Jail on a charge of second-degree murder.

Parker’s remains have not been found.

Rajan Joshi, who has served as Smith’s defense attorney since 2011, told News 6 Thursday that the affidavit is 46 pages. He described the evidence outlined in the affidavit as “circumstantial.”

Orlando police said Wednesday that advanced digital forensics helped analyze old evidence. They also said investigators uncovered new evidence.

The details of the investigation, however, are still murky. The court sealed the affidavit at the request of an Orlando police detective.

Joshi had the opportunity to review the affidavit prior to Smith’s first appearance, but said that because the order was sealed, he was not immediately able to have a copy.

On Friday afternoon, prosecutors filed an unopposed motion that asks the court to modify the order to seal, in addition to enacting a protective order.

If granted, Joshi and members of his defense team would be able to obtain copies of the affidavit, but the protective order would stipulate that they “safeguard” the report.

A bond hearing has not yet been set for Smith, who remains inside the Orange County Jail.

Orlando police say Parker disappeared November 17, 2011 after she brought the kids she shared with Smith to Smith’s home. That same day, an episode of “The People’s Court” aired, featuring Parker and Smith in a legal dispute over a $5,000 engagement ring.

Ten years prior to Parker’s disappearance, Smith was dishonorably discharged from the Marine Corps for drug-related and assault charges.
