A 59-year-old Ormond Beach gate attendant has been jailed after investigators said he fired “warning shots” at another man in the neighborhood, according to the police department.

In a release, police said the shooting happened around 7:45 a.m. at 100 Merimont Lane.

Per investigators, the shooting was tied to a separate DUI crash that occurred at 1502 Fountain View Street, in which the driver — identified as 24-year-old Autumn Sollitto — was arrested.

“According to the initial investigation, Sollitto’s boyfriend was in the neighborhood looking for her,” the release reads. “As he walked along Plantation Oaks Boulevard toward Merimont Lane, a gate attendant instructed him to leave the area.”

The two then “exchanged words,” with the boyfriend trying to explain why he was in the neighborhood, police said.

However, the gate attendant — identified as Gary Nagel — pulled out a handgun and fired warning shots, the release shows.

“The man ran down the street as (Nagel) continued firing several rounds into the ground near him,” the release continues. “No one was injured.”

Afterward, Nagel was arrested and now faces charges of discharging a firearm in public and aggravated assault with a deadly weapon without intent to kill.

FDACS officials told News 6 on Wednesday that they have no record of Nagel having an active or expired D or G security guard license.

As such, FDACS confirmed it is opening an investigation to determine whether unlicensed security activity occurred.
